There is a hearing before Judge Vernon Smith at 0930 December 27 in
Marin County Superior Court, Department F. I can't attend, so it would
be very helpful if anyone else in the area has the time to be there.

On December 20, Judge Smith denied $cientology's latest effort to have
me found in contempt and jailed and fined for violating an injunction
the cult obtained from Marin Superior Court Judge Gary W. Thomas,
which prevents me from even mentioning the word "$cientology."

$cientology's position is, and Judge Thomas agreed, that the cult and
every cultists and their lawyers can say whatever they want about me,
no matter who false, perverse, defamatory or rotten and I cannot
respond to defend myself. Or if I do speak out, the cult gets me
jailed and fined. $cientology has already obtained two contempt
orders, both from former Judge Thomas, and two warrants for my arrest,
one from Judge Thomas, one from Judge Smith, for earlier "violations"
of the injunction.

The lastest list of "violations" the cult wants me jailed and fined
for includes a short talk I gave in December 1999 in Clearwater,
Florida, a radio interview on WMNF I did also in December, 1999 in
Tampa, Florida, and 131 postings to a.r.s. from February 20, 1998 to
July 10, 2000.

My position has been from the day Judge Thomas signed the cult's
injunctiion that it is unlawful. I don't know exactly why Judge Smith
denied $cientology's motion to have me held in contempt, but the Marin
IJ reporter suggests that he may very well have found the injunction
unlawful as well.

Judge Smith gave $cientology lawyer Andy Wilson permission to file
more papers and set another hearing for tomorrow, December 27. I
FeExed a request to the Court for two weeks to file a response to
whatever $cientology files. Andy Wilson says he will not oppose my
request, but will argue that one week for me to respond is plenty. I
don't trust Wilson in this situation one bit.

Even though the hearing tomorrow morning may only concern Judge
Smith's grant or not of my request, it would be very helpful if anyone
in the Marin County area can take a look in. You'll get to meet Andy
Wilson and maybe even a crime cult legal bureau staffer or two in tow.
And you'll get to meet Judge Smith, whom I believe I've never met.

Take the opportunity if you have time after the hearing to see what
you get when ask for the Court file in the clerk's office. Marin SC
